IHC Orders One-Month Deadline to Finalise Sheesha Cafe Rules

The Islamabad High Court has directed the federal government to finalise rules governing sheesha cafes within one month, stepping up pressure for a clear regulatory framework in the federal capital. The written order addresses the prolonged delay in finalising the Prohibition of Sheesha Smoking Rules, 2023, which remain under consideration by the Federal Cabinet.

The court expressed concern that the matter had remained unresolved despite its implications for public health, particularly the well-being of younger people. Officials from the Ministry of National Health Services, Regulations and Coordination informed the court that the proposed rules had not yet completed the federal approval process, prompting the bench to set a deadline for action.

The Advocate General for Islamabad and the Additional Attorney General were directed to take up the issue with the competent authorities and pursue finalisation of the regulatory framework. The court also ordered that a compliance report be submitted within the one-month period, creating a formal timeline for the government to demonstrate progress on the pending rules.

Islamabad Capital Territory Police informed the court that enforcement measures were already being taken against unlawful sheesha-related activities. These measures include registration of cases, specialised teams, surveillance and periodic inspections of establishments suspected of violating applicable requirements. The police have been directed to continue lawful action against illegal sheesha operations and narcotics-related offences.

The Anti-Narcotics Force was also told to operate within its statutory mandate and coordinate with Islamabad police and other relevant agencies when there is material suggesting an establishment may be involved in narcotics-related activity. The direction brings multiple enforcement bodies into the regulatory effort while keeping their responsibilities within the limits prescribed by law.

At the same time, the court drew a distinction between illegal activity and businesses operating lawfully. Authorities were told not to use coercive measures against restaurants or establishments conducting business legally and serving sheesha under permits issued by competent authorities. Where an establishment is found violating a law or the conditions of a permit, however, the relevant legal process may proceed.

The ruling follows earlier action in Islamabad where the district administration announced a complete ban on sheesha cafes while the regulatory issue remained under consideration. The latest order shifts attention toward completing a formal legal framework rather than relying solely on temporary enforcement arrangements. The next significant step will be whether the Federal Cabinet and relevant ministries finalise the pending rules within the court-imposed deadline and provide the required compliance report.
